The North Cornwall Planning Commission on Wednesday, Jan. 25, unanimously conditionally approved a preliminary/final land development plan for a new Sheetz location at 2150 W. Cumberland St.

The decision was conditional on written approval by the City of Lebanon Authority (COLA) and the township’s sewer engineer, Act One & Associates.

The North Cornwall Zoning Hearing Board approved several waivers and a special exception for the 4,959-square-foot Sheetz location last September.

Developers requested and were granted deferment on constructing sidewalk along Cumberland Street. Should the township deem a sidewalk on Cumberland necessary, developers have enough space and would be required to install a sidewalk along the edge of the property.

The LDP includes the widening of Cumberland to add a right turn and deceleration lane to allow for safer access to the property.

Sheetz was also granted a 50-foot access easement along the entirety of Walnut Alley, which was never dedicated to the township.

Other businesses in the Lebanon Valley Mall would continue to have access to the road, but Sheetz (and any future owners of the property) would take on liability for its maintenance.

The land development plan also includes a sidewalk along the northern part of Walnut Alley, connecting with the sidewalk on east 22nd Street. This sidewalk is planned to eventually connect with the Lebanon Valley Rail Trail.

Various waivers were requested and unanimously granted. All waivers, save for those concerning the Walnut Alley easement, have already been discussed by the commission, township engineer Steve Shirk noted.

Subdivision and Land Development Ordinance waivers:

  • 403.6.B and 407.1 requiring a Water Service Feasibility Report: waiver conditional on COLA allowing connection to the public water system and providing water for the development, as well as providing written approval.
  • 403.6.C and 407.2 requiring a Sewer Service Feasibility Report: waiver conditional on approval by Act One & Associates, connection to the existing public sewer system, and design meeting North Cornwall Township required specifications.
  • 502.12 requiring sidewalks: waiver granted based on a a deferment agreement requiring Sheetz to install sidewalks along Cumberland if asked by the township at a later date.
  • 502.15.B and 503.2.D requiring an Ownership, Use, and Maintenance Agreement amongst landowners along Walnut Alley: waiver granted based on Walnut Alley easement.

The commission also unanimously granted waivers to 301.P, 403.E, 403.E.8, 403.E.9, and 403.E.10 of the Stormwater Management Ordinance to allow for a blanket easement of the property rather than acquiring individual draining easements.

The land development plan will likely go before North Cornwall supervisors at their March 7 meeting for consideration.
