Non-food contact surfaces were not cleaned at a frequency to preclude the accumulation of dirt and soil.

3 – 501.16(A2)(B) Time/Temperature Control for Safety Food, Cold-Holding
Sour cream and butter were held at 59°F in the walk-in cooler rather than 41°F or below as required because the unit was not functioning properly.

4 – 903.11 (A-B)(D) Equipment, Utensils, and Linens, Storing
Observed clean food equipment and/or utensils in the prep area stored uncovered or not inverted. These items were also stored with water at the bottom of each one.

4 – 601.11(A) Equipment, Food Contact Surfaces, Non-Food Contact Surfaces, and Utensils
A container of food utensils, food contact surfaces, was observed to have food residue and was not clean to the sight and touch.

3 – 501.17 Ready-to-Eat, Time/Temperature Control for Safety Food, Date-Marking
Potentially hazardous ready-to-eat food prepared in the food facility and held for more than 48 hours, located in the facility, were not being date-marked. PIC was not able to specify when the items were made. Some items were discarded.

6 – 501.111 Controlling Pests
Potential rodent and insect harborage areas on the exterior of the building perimeter were observed around the rear door due to garbage and other debris in the area. The food facility inspection indicated evidence of insect activity, and the PIC said cockroaches were present and pesticide was being used in the prep areas. The pesticide shall be applied by a licensed applicator in order to be compliant with the laws of the Commonwealth of Pennsylvania.

46.1201 (a) Statutory Requirement
The new food facility was in operation for more than 60 days. The PIC failed to obtain a Food Manager Certification. This is required within 90 days.

6 – 301.11 Handwashing Cleanser, Availability
Soap was not available at the handwash sink in the prep area.

6 – 501.111 Controlling Pests
The food facility inspection indicated evidence of rodents and insect activity in the prep areas, but the facility either did not have a pest control program or the program was not effective. The food facility was not removing dead or trapped pests from control devices frequently, as evidenced by the observation of approximately eight old/decaying mice/mice carcasses in the pest control device in the prep area.

4 – 501.12 Cutting Surfaces
Observed deeply scored cutting boards not resurfaced or discarded as required.

6 – 202.15 Outer Openings, Protected
There was a gap under the door located in the prep area of the food facility, which did not protect against the entry of insects, rodents, and other animals.

Refuse was not being stored in receptacles or waste handling units that are inaccessible to insects and rodents because the lids were open or missing from each of the containers at the rear of the facility.

5 – 205.11 Using a Handwashing Sink-Operation and Maintenance
The handwashing sink in the prep area was blocked by numerous items and was not accessible at all times for employee use. The handwashing sink in the front service area had a wiping cloth in the sink.

6 – 501.114 Maintaining Premises, Unnecessary Items, and Litter
The basement was disorganized and contained a significant amount of rubbish and other trash.

The food facility was reusing a plastic deli container, an item which is intended to be a single-use article, as a scoop for dry ingredients. Using a deli container as a scoop creates the risk of a piece of foreign material (plastic) getting into the food. The use of a durable scoop would eliminate this hazard. Discarded the deli container.
